1. Terms of Use
“Nine Gems” is a brand of Kimberlite Facets Private Limited, a retailer, wholesaler and exporter of natural gemstones, diamonds and jewellery based in Bengaluru, India. We operate a physical store and an ecommerce website at https://www.9gems.in. We accept orders from customers in India and internationally and ship to countries and destinations that can lawfully and practically be serviced.
We do not operate as a marketplace. In limited cases, select gemstones not held in our physical inventory may be listed; in all such cases, product responsibility and authenticity remain with our Company.
We also supply products to independent resellers, including jewellers and astrologers, who may sell them through their own stores, websites or other channels. These Terms apply to purchases made directly from Nine Gems through our website or physical store. A purchase made from an independent reseller is also subject to that reseller’s invoice, sale terms, return policy and legal obligations. Unless expressly stated otherwise, a reseller cannot amend these Terms or make commitments on behalf of Kimberlite Facets Private Limited.
Users under 18 may browse the website.
Orders should be placed by individuals aged 18 or older. If a minor places an order using an adult card or account, we may require verifiable permission from the adult card or account holder.
Retail checkout may generally be completed without creating a customer account. We collect the details needed to process payment status, prepare the invoice, complete any required verification, dispatch the product and provide customer support.
Reseller registration, reseller login, My Account or other account-enabled services may be provided separately. If you create or use an account, you are responsible for providing accurate information, safeguarding your credentials and all activity conducted through the account. We may verify reseller applications and may approve, decline, suspend or close reseller access where reasonably necessary.
An order is subject to product availability, successful payment, applicable KYC or fraud checks, export and delivery restrictions, and our acceptance. We may place an order on hold or cancel it because of product unavailability, an obvious pricing or listing error, failed payment, suspected fraud, unmet KYC requirements, delivery restrictions or a legal obligation. If we cancel an order after receiving payment, the applicable refund will be processed according to our published policy and applicable law.
Prices are displayed in INR by default. International viewers may switch currencies for convenience. Final charges may vary according to the exchange rates and fees applied by your payment provider or PayPal.
For international orders, the customer is responsible for customs duties, import taxes, clearance charges or similar amounts imposed in the destination country unless the product page or checkout expressly states that such charges are included.
Images may vary due to lighting and display settings. Measurements and weights are approximate unless expressly stated otherwise on the product page.
Natural gemstones are individually formed products and may contain inclusions, colour variations and other characteristics consistent with their natural origin. Treatments, enhancements and material product characteristics are disclosed on the relevant product page or accompanying report where applicable.
BIS Hallmarking — All gold jewellery sold under the Nine Gems brand is BIS Hallmarked in accordance with applicable Bureau of Indian Standards regulations, confirming purity as required under Indian law.
nticity and certification — We source and sell natural gemstones and jewellery. Where indicated on the product page, items may be accompanied by reports from reputed domestic or international laboratories, for example IGI, GII, IIGJ, GRS Switzerland, GUILD Gem Lab, GIC Colombo, GIA and SSEF. Please refer to our Gemstone Certifications information for further details.
Where a product is purchased through a reseller, the reseller’s invoice should identify the item sold. Any accompanying Nine Gems or independent laboratory report should be retained with the product and may be checked through the applicable report-verification service where available.
In compliance with applicable laws and regulatory guidance, including relevant RBI and Government of India KYC requirements, we may conduct identity verification for high-value orders before dispatch. This may require valid KYC documentation such as PAN, Aadhaar, Passport or other government-issued identification. PAN is mandatory for certain high-value transactions under applicable regulations. We may place orders on hold or cancel them where KYC requirements are not satisfied or where risk controls require it.
KYC information is used for verification, fraud prevention, regulatory compliance and related record-keeping and is handled in accordance with the Privacy Policy below.
Online payments are routed through payment aggregators or gateways such as Razorpay and PayPal, or another payment provider displayed at checkout. Depending on availability, these providers may support cards, UPI, net banking, wallets, bank transfers or other payment methods.
We do not collect or store full card numbers, card PINs, CVVs, net-banking passwords or similar payment credentials on our website. Payment credentials are entered into and processed through the relevant payment provider’s secure systems. We may receive limited transaction information such as the payer’s name, payment status, amount, currency, transaction reference and fraud-screening result so that we can confirm and administer the order.
Payments made at our physical store may be processed through cash, banking channels, card terminals, payment links or other available methods. We retain invoices and transaction references as required for accounting, tax, fraud-prevention and legal purposes, but do not store customers’ full card or banking credentials.

International delivery is subject to export documentation, carrier availability, destination-country restrictions, customs clearance and payment of applicable import charges.
Our website Delivery & Return Policy applies to products purchased directly from Nine Gems. If a product was purchased from an independent reseller, the customer should first contact that reseller, and the reseller’s sale and return terms will apply subject to applicable consumer law.
You agree not to engage in unlawful activity; probe, scan or test the website; interfere with security features; or submit information that is false, misleading or infringes third-party rights. Unauthorized scraping, bulk data extraction or spam is prohibited.
You must not misuse reseller or customer login facilities, impersonate another person, introduce malicious code, attempt fraudulent transactions or use product images, reports or certificate details to misrepresent another product.
All website content — including text, product information, images, designs, logos and trademarks, including “Nine Gems” — is owned by or licensed to Kimberlite Facets Private Limited. No rights are granted except as necessary for normal use of the website. You may not copy, modify, distribute or create derivative works except as permitted by law or with prior written consent.
Resellers may use Nine Gems content only to the extent expressly permitted by their written arrangement with us. Product photographs, report images, descriptions and trademarks must not be used in a misleading way or for products not supplied or identified by Nine Gems.
We may revise products, features or website content at any time. We may update this policy; changes take effect upon posting unless a later effective date is specified. A policy update will not retroactively alter the agreed terms of an accepted order except where required by law or agreed with the customer.
Except where expressly stated on a product page, the website and products are provided on an “as is” and “as available” basis, subject to applicable consumer laws.
To the maximum extent permitted by law, our aggregate liability for a claim relating to a product purchased directly from Nine Gems is limited to the price paid for the product giving rise to the claim. Risk in the product passes upon safe delivery, subject to our Delivery & Return Policy, Buy-Back Policy, any express product commitment and rights that cannot lawfully be excluded.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, opportunity or data, arising from use of the website or a product.
We are not liable for delays or failures caused by events beyond our reasonable control, including carrier delays, customs or regulatory holds, or force majeure.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, statutory consumer rights, or any other liability that cannot lawfully be excluded or limited.
This policy and any dispute arising out of or relating to it are governed by the laws of India and the State of Karnataka. You agree to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, subject to applicable law.
2. Privacy Policy
This Privacy Policy explains what personal information Kimberlite Facets Private Limited collects through the Nine Gems website, direct orders, physical-store interactions, reseller services and related customer support; why we collect it; how we use and share it; how long we retain it; and the choices available to you.
Kimberlite Facets Private Limited is responsible for personal information processed for Nine Gems’ own business purposes. Depending on the applicable law, we may be described as the data controller or data fiduciary.
Independent resellers generally control the customer information they collect through their own stores, websites or sales channels. Their privacy practices apply to that collection. If a reseller provides information to Nine Gems for order fulfilment, certification support, product verification, warranty assistance, legal compliance or another disclosed purpose, we process that information as described in this policy.
Contact details: Name, email, phone, billing address and shipping address.
Order and transaction details: Products, values, payment status, transaction references, invoices, delivery information, returns and refunds.
Technical data: Device or browser type, IP address, timestamps, pages visited, referral URLs, cookie identifiers and approximate location derived from IP address.
Communications: Support requests, enquiries, preferences and records of relevant correspondence.
Retail checkout information: Information required to prepare an invoice, verify the order, arrange domestic or international shipping, communicate delivery updates, handle returns and provide after-sale support. Retail checkout does not require the creation of a customer account where guest checkout is available.
Reseller information: Business or professional name, contact person, address, tax or registration information, website or sales-channel details, login credentials, application information, order history and communications needed to assess and manage a reseller relationship.
Physical-store information: Contact, invoice, order, payment-reference, product-selection, repair or service information provided when you visit or purchase from our Bengaluru store.
KYC information: PAN, Aadhaar, Passport or other government-issued identification where identity verification is required by law or reasonably necessary for a transaction.
Payment information received from providers: Payment status, amount, currency, transaction reference and related confirmation or fraud-screening information. Nine Gems does not receive or store full card numbers, PINs, CVVs, net-banking passwords or similar payment credentials.
Information from resellers and service providers: We may receive information from a reseller when necessary to support a sale involving a Nine Gems product, and from payment, delivery, insurance, fraud-prevention or communications providers involved in a transaction.
We use personal information:
To accept and fulfil orders, provide customer support and manage deliveries.
To process secure payments through Razorpay, PayPal or another available payment provider. We do not store full card or banking credentials.
- To maintain website security, prevent fraud and improve performance, content and user experience.
- To comply with legal obligations including tax, accounting, KYC, export, customs and regulatory requirements.
- To prepare invoices, complete export and customs documentation, arrange insured domestic or international shipping, track delivery, handle returns and refunds, and respond to product or certification enquiries.
- To process reseller applications, provide reseller login or account facilities, administer reseller orders, verify eligibility, maintain business records and support products supplied through reseller channels.
- To administer purchases and customer service at our physical store and connect an offline interaction with a later delivery, service or support request where necessary.
Marketing communications — We may send promotional communications by email, SMS, WhatsApp, phone or a similar channel where you have requested them, consented to them, or where otherwise permitted by applicable law. You may opt out at any time using the mechanism provided in the message or by contacting us. Transactional communications relating to an order, payment, account, delivery, security or requested service will continue where necessary.
We process personal data on one or more lawful grounds — performance of a contract for orders, compliance with legal obligations including KYC and tax, legitimate interests such as fraud prevention, security and service improvement, and consent for marketing where required.
Depending on the purpose and applicable law, processing may also be based on steps you request before placing an order, your consent to non-essential cookies, or another lawful or permitted use recognized under applicable data-protection law. Where we rely on legitimate interests, we consider whether those interests are outweighed by your rights. Where we rely on consent, you may withdraw it at any time without affecting processing lawfully completed before withdrawal.
We may share personal information with:
- Payment processors, including Razorpay and PayPal, and other payment or fraud-prevention providers used for a transaction.
- Logistics and insurance partners for pickup, transit and delivery.
- Customs agents, export-documentation providers, laboratories or certification-support services where necessary for an order or service.
- Hosting, analytics, security, communications and customer-support vendors operating under appropriate safeguards.
- Regulators, law-enforcement authorities, auditors or professional advisors where legally required or reasonably necessary to protect rights.
- Parties involved in a merger, acquisition, financing, reorganization or sale of all or part of the business, in accordance with applicable law.
Where a sale or enquiry involves an independent reseller, information may be shared with that reseller when the customer is aware of the reseller’s involvement and the sharing is necessary to process the transaction or provide requested support. Resellers are responsible for their own use of information when acting independently.
We limit sharing to information reasonably necessary for the relevant purpose. Providers acting on our behalf are expected to use information in accordance with our instructions, confidentiality requirements and applicable law.
Because we serve international customers and use global service providers, your information may be processed outside your home jurisdiction. We take reasonable steps to protect personal information during such transfers in accordance with applicable law.
Nine Gems is based in India, so information provided by an international customer will ordinarily be received and processed in India. Information may also be processed in countries where payment, communications, hosting, fraud-prevention or delivery providers operate. Where applicable law requires safeguards for an international transfer, we use a lawful transfer mechanism or other measures required by that law.
We retain personal information only for as long as necessary to fulfil the purposes set out in this policy and to meet business, tax, accounting and legal obligations. Thereafter, we securely delete or anonymize the information.
The applicable period depends on the nature of the information, the duration of the customer or reseller relationship, legal record-keeping requirements, product-support needs, fraud risk and relevant limitation periods. Order, invoice, export and KYC records may be retained for the period required by applicable law even after an order has been completed. Reseller account information may be retained while the account or business relationship remains active and for an appropriate period afterwards.
We implement reasonable technical and organizational measures to protect personal information from unauthorized access, alteration, disclosure or destruction. No method of transmission or storage is completely secure; absolute security cannot be guaranteed.
Our measures include access controls, secure transmission, restricted access to KYC and order records, website monitoring and appropriate service-provider safeguards. Where required by applicable law, we will notify affected individuals or the relevant authority of a personal-data breach.
Subject to applicable law and relevant exceptions, you may:
- Request access to or a summary of your personal information and how it is processed.
- Request correction, completion or updating of inaccurate or incomplete information.
- Request deletion or erasure of personal information that is no longer required.
- Withdraw consent where processing is based on consent.
- Object to or request restriction of certain processing.
- Request portability of information you provided, where applicable.
- Opt out of promotional communications at any time.
- Nominate another person to exercise applicable rights in the event of your death or incapacity, where this right is available.
Raise a grievance with us and, where applicable, complain to the competent data-protection authority.
Manage cookies and similar technologies through the cookie consent manager and browser settings.
To exercise a right, email support@9gems.in with the subject “Privacy Request” or “Grievance.” We may request information reasonably necessary to verify your identity and protect your information.
These rights are subject to applicable legal exceptions. We may retain information where required for tax, accounting, KYC, fraud prevention, dispute resolution, legal claims or the protection of another person’s rights.
Users under 18 may browse the website, but orders should be placed by an adult. Nine Gems’ products, reseller services and account facilities are not directed specifically at children.
We do not knowingly seek to collect a child’s personal information without the involvement or verifiable consent of a parent or lawful guardian where such consent is required. If we learn that a child’s information has been collected in circumstances requiring parental or guardian consent and no valid consent exists, we will take reasonable steps to delete the information or obtain the required authorization.
We may update this Privacy Policy from time to time. Updates will be posted on this page with a revised “Last updated” date. Where a change materially affects how we use personal information, we will provide additional notice or request consent where required by applicable law.
3. Cookie Policy
Cookies are small text files stored on your device that help the website function and help us understand how it is used. We may also use similar technologies such as pixels and local storage.
We may use:

- Performance and analytics cookies to measure usage, diagnose issues and improve website content and performance.

Payment providers such as Razorpay, PayPal or another provider displayed at checkout may use their own cookies or similar technologies when their payment service is opened or used. Those technologies are governed by the provider’s privacy and cookie information.
The cookie consent manager provides available details about cookie categories, purposes, providers and duration. The categories displayed in the consent manager reflect the cookies and choices made available on the website.
You can manage non-essential cookie preferences through the cookie consent manager available on the website. Where consent is required, non-essential cookies will be used according to your choices. You may change or withdraw those choices at any time by reopening the cookie settings.
Cookies necessary for the shopping cart, checkout, security, login, consent records and other basic website functions cannot be disabled through the consent manager. You may block or delete cookies through your browser settings, but doing so may affect cart contents, guest checkout, reseller login, currency preferences or other website functions.
Withdrawing cookie consent does not affect processing that occurred before withdrawal and may not automatically remove cookies already stored on your device. Stored cookies can be deleted through your browser settings.
4. Disclaimer
Product information — including weights, sizes and imagery — is provided in good faith. Minor variances may arise due to measurement methods, gemstone characteristics and photography.
Treatment disclosures, certifications and origin details are provided on the respective product page where available. Certification availability varies by product as indicated.
Laboratory reports record the findings and professional opinion of the issuing laboratory for the examined item at the time of testing. Terminology, testing methods and opinions may vary between laboratories. A product certification is evidence relating to the identified product; it is not a guarantee of future market value, resale value or investment performance.
Nothing on the website constitutes financial, investment, medical or legal advice. Purchasing decisions should be made after independent consideration.
Any astrological, spiritual, cultural, traditional or wellness-related information about gemstones is provided for general information. Individual beliefs and results may vary, and Nine Gems does not guarantee any astrological, medical, financial or other outcome from owning or wearing a gemstone or jewellery product.
